These Terms and Conditions (“Terms”) govern your use of Maxland Int’l Inc.’s messaging services in compliance with the 10-Digit Long Code (10DLC) regulations established by mobile carriers and regulatory authorities. By using our services, you agree to comply with these Terms.
1. Definitions
- 10DLC (10-Digit Long Code): A registered and approved 10-digit phone number used for business messaging in the U.S.
- The Company: Refers to Maxland Int’l Inc., the provider of the messaging service.
- End User: Any individual receiving SMS/MMS messages from Maxland Int’l Inc.
- Message Campaigns: Business-related SMS/MMS communications sent through our platform.
2. Compliance with 10DLC Regulations
- All messaging campaigns must be registered with the appropriate mobile carriers and adhere to their guidelines.
- Messages must comply with the Telephone Consumer Protection Act (TCPA) and other applicable laws.
- Consent is required before sending messages to end users. Opt-in must be obtained through an approved method.
- Opt-out mechanisms must be provided in every message (e.g., “Reply STOP to unsubscribe”).
- Messages must not contain prohibited content, including but not limited to spam, fraudulent activity, illegal substances, or misleading promotions.
3. Message Content Guidelines
- Messages must be relevant to the registered campaign use case.
- No misleading, deceptive, or harmful content is permitted.
- Carriers may filter or block messages that violate compliance requirements.
4. User Responsibilities
- Users must ensure they have obtained explicit consent before sending messages.
- Users are responsible for maintaining accurate records of opt-in and opt-out requests.
- Users must comply with carrier policies, including daily sending limits and prohibited message types.
5. Enforcement & Violations
- Violation of these Terms may result in message blocking, carrier fines, or service suspension.
- Repeated violations may lead to account termination.
- The Company reserves the right to update these Terms as needed to comply with regulatory changes.
6. Opt-In & Opt-Out Policy
- Opt-In: Users must obtain consent before sending messages. Common methods include web forms, SMS keyword confirmation, or written agreements.
- Opt-Out: Users must provide recipients with an option to unsubscribe. A recipient may reply STOP at any time to be removed from messaging lists.
7. Data Privacy & Security
- User data is handled according to our Privacy Policy.
- We do not sell, share, or misuse end-user data.
- All data is secured using industry-standard encryption methods.
8. Limitation of Liability
Maxland Int’l Inc. is not responsible for carrier filtering, message delays, or technical issues beyond our control. Users assume full responsibility for compliance with 10DLC requirements.
9. Amendments
These Terms may be updated from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
